Pardons, paroles and clemency files, 1835-1837.

The Constitution of 1819 gave the Governor of Ala. the power to grant reprieves and pardons in all criminal and penal cases, except those of treason and impeachment, and to remit fines and forfeitures. This series consists of correspondence, petitions, legal documents, etc. relating to pardons from crimes, parole from sentences and remission of fines imposed. The offenses include assault and battery, murder, and manslaughter, as well as less serious offenses such as horse stealing, larcency, affray, counterfeiting, and malicious mischief. A large number of the offenses relate to gambling. Individuals seeking clemency include Demsey Dowling, John Guy, James Howard, Samuel Lowry, James McCaghren, Jeremiah Terry, Robert Bell, Uriah Bass, Archibald Campbell and John D. Fuller. Of particular interest are the cases of James Howard, who was convicted of manslaughter in the whipping death of a female slave; Joe, Abner McGehee's slave, who was convicted of attempted murder; and Robert Bell convicted of operating a mill pond as a nuisance in the town of Livingston, Ala. Also of note is a petition from the pupils of the North Ala. Female Academy protesting the use of capital punishment in the case of Jeremiah Terry who was convicted for attempting to pass counterfeit bills.
